TERMS AND CONDITIONS (WITH EFFECT OF 20.01.2018)

Ticketmaster – Ticketmaster Poland spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, entered in the register of entrepreneurs kept by the District Court for the capital city of Warsaw, XIII Commercial Division of the National Court Register, under the National Court Register No. (KRS) 0000376096, address: ul. Bukowińska 22B, 02-703 Warsaw, Tax Identification No. (NIP) 1080010023, Statistical Identification No. (REGON) 142772043, with the share capital of PLN 4,000,000, which distributes tickets for cultural and sports events by means of the Sales System.

§1 Definitions

1. Ticket – a confirmation of the agreement entered into by the User, which entitles the User to participate in an Event organised by an Event Partner. Depending on the type of the Event, a Ticket may be personal, i.e. only the person whose name is specified on the Ticket may participate in the Event, or it may be issued to bearer. A Ticket is verified once, when the User enters the Event, and it may not be used again. A Ticket for disabled persons means a Ticket which entitles its holder to enter into a special designated area which may be accessed by a person in a wheelchair.

2. Collector Ticket – a Ticket in the form of a card with a colourful overprint, available only for orders made on the website www.ticketmaster.pl or partner websites, issued for the selected Events.

3. Proof of Purchase – a Ticket or another document that confirms the purchase of a Ticket, in particular:

– credit card statement,

– e-mail confirmation,

– receipt

4. Working Day – each day except Saturdays, Sundays and other public holidays.

5. User Service – the point that provides information to the Users. The User Service may be contacted by telephone or e-mail on Working Days, from 9:30 to 17:00, telephone number: +48 22 3958700, e-mail: info@ticketmaster.pl. The fee for calls to the User Service is consistent with the tariff of the User's telecommunications operator.

6. Event – any cultural, sports or other event organised by an Event Partner, the Tickets for which are distributed by means of the Sales System.

7. Order Amount – the sum of the Ticket price, costs of delivery, costs of additional services and the Handling Fee. The User is informed about the final Order Amount before the confirmation of the order.

8. Mobileticket – a mobile ticket available exclusively for purchases by means of Android and iOS applications.

9. Venue – a place in which a given Event is held.

10. Handling Fee – a transaction fee due to the processing of payment in the amount of 3% of the sum total of the Ticket price, delivery costs and costs of additional services.

11. Event Partner – a natural person, a legal person or an organisational unit that organises an Event or offers the opportunity to participate in an Event and/or from whom Ticketmaster receives Tickers and/or related products and services intended for sale.

12. Platinum – the offer of in demand seats for a given Event. The purchase prices of Platinum Tickets are determined dynamically, and they increase/decrease depending on the interest in the offer. A Platinum Ticket does not include any additional services or products.

13. Terms and Conditions – these Terms and Conditions of the distribution of tickets by Ticketmaster by means of the Sales System.

14. Terms of the Event Partner – the terms and conditions of a specific Event determined by the Event Partner, available on the Event Partner's website.

15. Venue Rules – the terms and conditions that set out the rules applicable to the Users who participate in the Event that is to take place at a given Venue, available on the website of the Event Partner or the Venue.

16. Sales System – the IT system for distribution of Tickets used by Ticketmaster, which allows for handling the order placement process, the distribution and receipt of Tickets, as well as Ticket returns.

17. TicketFast – a Ticket generated electronically, which, upon printing, authorises the User to participate in the Event for which it is issued. A printed TicketFast has the force of a Ticket and the regulations pertaining to Tickets are applicable to TicketFasts accordingly. A TicketFast should be printed by the User in its entirety, on a white A4 sheet, in a legible manner, and it should include a barcode.

18. User – any person that uses the Sales System on the website www.ticketmaster.pl and purchases a Ticket by means of the Sales System.

§2 General provisions

1. The present Terms and Conditions apply to the sales of Tickets by means of the Ticketmaster system; however, the Terms of the Partners of the respective Events or the Venue Rules may impose additional obligations on the Users, which are not listed in this document.

2. Ticketmaster sells Tickets and related products and/or services on behalf of the Event Partners. Ticketmaster is not the organiser of Events.

3. Ticketmaster sells Tickets upon the receipt of the Tickets from the Event Partners. The number of Tickets made available for sale differs depending on a given Event. Tickets are sold by means of several distribution channels, including the Sales System, and in some cases – at ticket offices. All points of sale have access to the same Ticket Sales System. In some cases, additional Tickets may be made available for sale prior to the commencement of the Event. Ticketmaster does not have any influence on their number or availability.

4. In the case of some Events, Tickets may be sold as part of “Packages” or “Extended Packages”. As part of a Package, a Ticket is sold along with additional entitlements, products or other benefits, such as exclusive seats, lodging, transport, board or the official merchandise. As part of an Extended Package, apart from a Ticket, the User may book a parking space, purchase the official merchandise etc.

5. Ticketmaster’s offer is available only for persons who have reached 18 years of age.

6. The User is obliged to make sure that they have the proper operating system, software and device to be able to use the Sales System. The detailed technical requirements are presented during the buying process.

7. In order to buy Tickets in the Sales System, it is necessary to finalise the transaction by making the payment within 10 minutes as of the commencement of the booking process. If the User fails to pay for the booking within the specified period, the Tickets return to the pool of Tickets for sale.

8. Each purchase made in the Ticketmaster service is subject to:

a) the present Terms and Conditions,

b) the special terms and conditions that may be published on the Ticketmaster's website,

c) the terms and conditions that may be specified by the Event Partner(s) and/or the terms and conditions of the Event,

d) the terms and conditions specified in the Venue Rules.

9. The terms and conditions related to the Venue are set out in the Venue Rules available at the entrance to the Venue, on the area of the Venue and on the Venue's website.

10. All purchases require the verification of payment card and other actions in order to ensure safety; therefore, a transaction may be invalidated in the event that it does not pass the verification process.

11. Before the purchase of a Ticket, the User is obliged to read the Terms and Conditions and any additional information available on the website: www.ticketmaster.pl.

12. If the Event Partner implements the terms and conditions of participation in a given Event, the provisions of such terms are binding upon the Users. Ticketmaster will make the Terms of the Event Partner available to the Users by uploading them on the Event Partner's website. If the User buys Tickets to Events in the case of which the terms of participation are determined in the Terms of the Event Partner, the User accepts them while confirming the order.

13. The owner or manager of the Venue of the Event may specify the Venue Rules. The Venue Rules apply to Users who are on the area of the Venue. The terms and conditions of using the Venue will be published on the website of the Event Partner or the Venue.

14. Ticketmaster reserves the right to cancel a transaction which raises reasonable suspicion that the purchase was made in violation of the Terms and Conditions. Tickets purchased as part of such transaction cease to be valid.

15. User during Ticket purchase, for some events, have possibility to purchase additional contract of ticket insurance which covers customer in the case of the occurrence of an event preventing the insured person from participating in the event .Rules of coverage are available in the general insurance terms and conditions of Bezpieczny bilet [Safe ticket]

§3 Signing in to the Sales System and the rules of buying Tickets

1. To place an order, it is necessary to establish an account in the Sales System. The User has to give their e-mail address and password, and provide the data required for the full use of the account.

2. The User may change the provided data in the Sales System, under the “Edit Profile/Edit Address” tab. The order is fulfilled in accordance with the data provided by the User in a confirmed order.

3. Ticketmaster is not liable for any incorrect data entered in the Sales System by the User or for any change of data in the Sales System by the User, in particular the address data. In the event that the User notices an error in the provided data after the confirmation of the order, the User should contact the User Service.

4. Upon signing in to the Sales System, the User may buy Tickets for the Event of their choice. If the Organiser's Terms provide for the choice of specific categories of Tickets and places, the User chooses the Ticket category and place during the booking process. Depending on the provisions of the Organiser's Terms, the User may buy Tickets in the number specified on the Event's website in accordance with § 8(1) of the Terms and Conditions.

5. The User is obliged to check the data on the Ticket against the data presented in the Order placed by the User.

6. A Ticket allows for a single entrance to the Event of the number of persons specified on the Ticket (bearer's Ticket) or the persons whose names are listed on the Ticket (personal Ticket). If the Ticket does not contain any information about the number of persons allowed for a single entrance to the Event, the Ticket is only for one person.

§4 Prices and payment methods

1. Purchases made on the website of Ticketmaster are subject to the Handling Fee. The User is informed of the final Order Amount before the confirmation of the order.

2. The prices of Tickets may be dynamic and they may change during the sales period. The User is not entitled to receive a difference in the Ticket price.

3. The available payment methods are the following:

a) by means of Dotpay (in accordance with the terms and conditions of the service),

b) by a credit card (Mastercard, Visa) issued to the name of the User,

c) by a payment card,

d) in cash – only for purchases made in points of sale.

4. Some payment methods may be unavailable for some Events. The limitation may result from the time left until the beginning of the Event and/or the terms and conditions provided by the Event Partner. The details of payment methods and the choice of the payment method are available during the order placement process.

§5 Delivery methods

1. The available Ticket delivery methods are the following:

a) the Polish Post,

b) a courier service,

c) an electronic Ticket printable at home (Ticketfast®),

d) a Mobileticket,

e) collection of Tickets from the ticket office before the Event, available only in some cases.

2. The details of the delivery method and the related costs are available during the order placement process.

3. The User should order Tickets as much in advance as possible. If the User does not receive the Tickets five days before the Event, or if the User needs to travel in order to participate in the Event – five days before the travel, the User should contact the User Service of Ticketmster. It is necessary to provide the order number and the personal data of the User. In the event that it is impossible to deliver the Tickets by means of the Polish Post or a courier service, the Tickets may be delivered by means of the TicketFast option or collected from the ticket office directly before the Event. If necessary, the User will be informed of the details related to the collection of the Tickets by telephone or e-mail (in accordance with the information provided by the User during the order placement process). In order to collect the Tickets, the User has to present the booking confirmation sent by e-mail as well as their identity document with a picture.

4. If it is possible to collect the Ticket for a given Event in person from the ticket office directly before the Event, such information will be included in the description of the Event. In order to ensure the Users’ safety and to minimise the risk of collecting Tickets by unauthorised persons, the opportunity to collect the Ticket in person is contingent upon the provision of the following data:

a) the order number,

b) the first and last name of the User.

In addition, the User has to present their identity document.

5. The User is obliged to protect the access data to the User's account, as well as the data related to the order.

6. If the User authorises any third party to collect the Ticket, such third party has to know the data referred to in subsection 4 (a), (b) and (c), as well as have a written authorisation from the User to collect the Ticket, or have the User's identity document. Ticketmaster is not liable if the person authorised by the User loses, damages or fails to transfer the Ticket to the User, or uses it in any other undesirable manner.

§6 Rescission of the agreement

Pursuant to Article 38(12) of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827), the User is not entitled to rescind the agreement concluded with Ticketmaster by means of the Sales System.

§7 Tickets

1. A Ticket constitutes the confirmation of the agreement concluded between the User and Ticketmaster, which entitles the User to participate in the Event organised by a given Event Partner. Depending on the type of the Event, a Ticket may be personal or it may be issued to bearer.

2. A Ticket allows for a single entrance to the Event of the number of persons specified on the Ticket (bearer's Ticket) or the persons whose names are listed on the Ticket (personal Ticket). If the Ticket does not contain any information about the number of persons allowed to enter the Event, the Ticket is only for one person.

3. In the case of personal Tickets, Ticketmaster reserves the right to check the data presented on the Ticket against the data of the Ticket holder. If the data presented on the Ticket differs from the data of the Ticket holder, Ticketmaster may forbid such a person to participate in the Event for which the Ticket has been bought. Change of personal data is not permitted.For personalised tickets, Ticketmaster reserves the right to check personal details found on a personalised ticket against the details of the ticket administrator. In the event of any discrepancies between the personal details found on the ticket and personal details of the ticket administrator, Ticketmaster may deny such person access to the event covered by the ticket. Ticketmaster will agree to a change of personal details on a personalised ticket in consideration for PLN 30 fee per ticket, the price NOT includes the costs of mailing the ticket duplicate to the Client. If you need to change personal details on your ticket, contact us at info@ticketmaster.pl, make a payment, send us the original ticket(s) and complete the form.You may change personal details on your personalised ticket only once and only by order owner.

4. Tickets should be stored in a safe place. Ticketmaster is not liable for any lost or stolen Tickets. Direct sunlight or high temperature may cause permanent damage to the Ticket.

5. The terms and conditions specified by the Event Partners may exclude the opportunity to issue a duplicate of the Ticket in the event of its loss, theft, damage or destruction. A duplicate of the Ticket may be issued against payment.

6. The seat taken by the User during the Event must be consistent with the seat number specified on the Ticket. Ticketmaster, the owner or manager of the Venue and the Event Partner reserve the right to replace the seat initially assigned to the User or specified on the Ticket with other seats of the same or higher price category, before or during the Event.

7. Tickets may not be exchanged or returned upon the purchase.

8. Before the purchase of the Ticket, the User is obliged to read the present Terms and Conditions and the details of the Event.

§8 Limitations

1. For each Event, there is a limited number of Tickets available for purchase. The number of Tickets that may be purchased is specified on the first page informing of the terms and conditions of purchase and it is verified during each transaction. The Event Partner reserves the right to cancel the Tickets above the allowed number without notice in the event of exceeding;

a) the limit per one household ( address of residence ),

b) the limit per one credit card,

c) the limit per one User.

The Event Partner can cancel all orders of this User.

2. Tickets may be sold subject to certain access or use limitations, such as a limited or obscured view or side view, as well as the minimum age required to enter the Event.

3. The purchase of Tickets for the purpose of profitable resale or the profitable sale of Tickets constitute violation of the provisions of law and are considered petty offences under Article 133 of the Code of Petty Offences.

4. Without a written consent of the Event Partner and Ticketmaster, Tickets may not be used for advertising or promotional purposes, in competitions or lotteries.

§9 Cancellation, change of the time, place and programme of the Event, refunds

1. If the Event is cancelled or its programme, time or place are changed, Ticketmaster will inform the Users of this fact without undue delay by posting the relevant information on the website www.ticketmaster.pl. In addition, the Users may receive such information by e-mail.

2. If the Event is cancelled, except for a change of the date of the Event, the User is entitled to the refund of the Order Amount minus the Handling Fee. If the Event takes place for several days and one or several (but not all) days of the Event are cancelled, the User may receive a partial refund corresponding to the number of the cancelled days of the Event. The Handling Fee is non-refundable.

3. If there occur any material changes related to the Event, in particular a change of the date of the Event or a significant change of the place of holding the Event, the User may either reconfirm their order as regards the changed Event on the Terms of the Event Partner, or demand the refund of the Ticket price. If the User fails to notify Ticketmaster of their decision, Ticketmaster may reconfirm the User's participation in the changed Event, and thus deprive the User of the right to demand the refund of the Ticket price.

4. In order to return the Ticket, the User should send the Ticket return form

and the proof of purchase and original Ticket to the Ticketmaster adress by post. As regards a Ticketfast, the User should send the completed Ticket return form to the e-mail address: info@ticketmaster.pl along with the Proof of Purchase and Ticketfast.

5. A material change means a change that renders the Event materially different from the Event reasonably expected by the Users. The use of doubles in theatrical performances and/or any change as regards:

a) additional performances,

b) group members, and/or

c) programme of an Event with numerous performers (e.g. a festival) are not deemed significant changes.

§10 Enquiries and complaints

1. Any enquiries or complaints related to the purchase should be referred to the User Service along with the order number. The order number can be found on www.ticketmaster.pl under the “My Tickets” tab.

2. In the event of any dispute, Ticketmaster will make best efforts to resolve the dispute in the manner that will satisfy all interested Parties.

§11 Liability

The independent services ordered by the User, including tourist, hotel and accommodation services related to the Event, are organised at the User’s own risk. Ticketmaster is not liable to the User for the lack of opportunity to use such services.

§12 Entrance and participation

1. The manager of the Venue reserves the right to deny access to the Event if the User violates any terms and conditions of the Event or the terms and conditions specified by the Event Partner. The manager of the Venue may conduct occasional security checks in order to ensure the Users’ safety.

2. If any Users are late for the Event, efforts will be made to enable them to access the Event during a break; however, it may not be guaranteed that such Users will be able to attend the Event.

§13 Privacy

1. Ticketmaster Poland sp. z o. o. collects, stores and secures the Users’ personal data in accordance with the Personal Data Protection Act of 29 August 1997.

2. The personal data provided by the User is processed in order to perform the Ticket sales agreement and, at the User's consent, in order to provide information about new products, services and promotions offered by Ticketmaster.

3. The personal data disclosed by the User may be transferred to the Partner of the Event for which the User purchased a Ticket, only for the purposes related to the User's participation in the Event.

4. The User may access, rectify and complete their personal data, as well as demand its removal.

5. On the establishment of the account in the Sales System, the User consents to the processing of their personal data by Ticketmaster for the purpose of fulfilling the Ticket purchase orders or processing any returns or complaints.

§14 Final provisions

1. Any matters not settled in the present Terms and Conditions shall be governed by the provisions of the Civil Code.

2. Any disputes with the User shall be settled by the common court of competent jurisdiction determined pursuant to separate provisions.

15. Venue Rules – the terms and conditions that set out the rules applicable to the Users who participate in the Event that is to take place at a given Venue, available on the website of the Event Partner or the Venue.

16. Sales System – the IT system for distribution of Tickets used by Ticketmaster, which allows for handling the order placement process, the distribution and receipt of Tickets, as well as Ticket returns.

4. Upon signing in to the Sales System, the User may buy Tickets for the Event of their choice. If the Organiser's Terms provide for the choice of specific categories of Tickets and places, the User chooses the Ticket category and place during the booking process. Depending on the provisions of the Organiser's Terms, the User may buy Tickets in the number specified on the Event's website in accordance with § 8(1) of the Terms and Conditions.

5. The User is obliged to check the data on the Ticket against the data presented in the Order placed by the User.

6. A Ticket allows for a single entrance to the Event of the number of persons specified on the Ticket (bearer's Ticket) or the persons whose names are listed on the Ticket (personal Ticket). If the Ticket does not contain any information about the number of persons allowed for a single entrance to the Event, the Ticket is only for one person.

§4 Prices and payment methods

1. Purchases made on the website of Ticketmaster are subject to the Handling Fee. The User is informed of the final Order Amount before the confirmation of the order.

2. The prices of Tickets may be dynamic and they may change during the sales period. The User is not entitled to receive a difference in the Ticket price.

3. The available payment methods are the following:

a) by means of Dotpay (in accordance with the terms and conditions of the service),

b) by a credit card (Mastercard, Visa) issued to the name of the User,

c) by a payment card,

d) in cash – only for purchases made in points of sale.

4. Some payment methods may be unavailable for some Events. The limitation may result from the time left until the beginning of the Event and/or the terms and conditions provided by the Event Partner. The details of payment methods and the choice of the payment method are available during the order placement process.

§5 Delivery methods

1. The available Ticket delivery methods are the following:

a) the Polish Post,

b) a courier service,

c) an electronic Ticket printable at home (Ticketfast®),

d) a Mobileticket,

e) collection of Tickets from the ticket office before the Event, available only in some cases.

2. The details of the delivery method and the related costs are available during the order placement process.

3. The User should order Tickets as much in advance as possible. If the User does not receive the Tickets five days before the Event, or if the User needs to travel in order to participate in the Event – five days before the travel, the User should contact the User Service of Ticketmster. It is necessary to provide the order number and the personal data of the User. In the event that it is impossible to deliver the Tickets by means of the Polish Post or a courier service, the Tickets may be delivered by means of the TicketFast option or collected from the ticket office directly before the Event. If necessary, the User will be informed of the details related to the collection of the Tickets by telephone or e-mail (in accordance with the information provided by the User during the order placement process). In order to collect the Tickets, the User has to present the booking confirmation sent by e-mail as well as their identity document with a picture.

4. If it is possible to collect the Ticket for a given Event in person from the ticket office directly before the Event, such information will be included in the description of the Event. In order to ensure the Users’ safety and to minimise the risk of collecting Tickets by unauthorised persons, the opportunity to collect the Ticket in person is contingent upon the provision of the following data:

a) the order number,

b) the first and last name of the User.

In addition, the User has to present their identity document.

5. The User is obliged to protect the access data to the User's account, as well as the data related to the order.

6. If the User authorises any third party to collect the Ticket, such third party has to know the data referred to in subsection 4 (a), (b) and (c), as well as have a written authorisation from the User to collect the Ticket, or have the User's identity document. Ticketmaster is not liable if the person authorised by the User loses, damages or fails to transfer the Ticket to the User, or uses it in any other undesirable manner.

§6 Rescission of the agreement

Pursuant to Article 38(12) of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827), the User is not entitled to rescind the agreement concluded with Ticketmaster by means of the Sales System.

§7 Tickets

1. A Ticket constitutes the confirmation of the agreement concluded between the User and Ticketmaster, which entitles the User to participate in the Event organised by a given Event Partner. Depending on the type of the Event, a Ticket may be personal or it may be issued to bearer.

2. A Ticket allows for a single entrance to the Event of the number of persons specified on the Ticket (bearer's Ticket) or the persons whose names are listed on the Ticket (personal Ticket). If the Ticket does not contain any information about the number of persons allowed to enter the Event, the Ticket is only for one person.

3. In the case of personal Tickets, Ticketmaster reserves the right to check the data presented on the Ticket against the data of the Ticket holder. If the data presented on the Ticket differs from the data of the Ticket holder, Ticketmaster may forbid such a person to participate in the Event for which the Ticket has been bought. Change of personal data is not permitted.For personalised tickets, Ticketmaster reserves the right to check personal details found on a personalised ticket against the details of the ticket administrator. In the event of any discrepancies between the personal details found on the ticket and personal details of the ticket administrator, Ticketmaster may deny such person access to the event covered by the ticket. Ticketmaster will agree to a change of personal details on a personalised ticket only for valid and justified reasons in consideration for PLN 30 fee per ticket; the price includes the costs of mailing the ticket duplicate to the Client. Ticketmaster reserves the right to demand further evidence or refuse to change personal details without stating the reason. If you need to change personal details on your ticket, contact us at info@ticketmaster.pl, specify the reason for the change, make a payment, send us the original ticket and complete the form.You may change personal details on your personalised ticket only once, at least two weeks before the scheduled date of the event.

4. Tickets should be stored in a safe place. Ticketmaster is not liable for any lost or stolen Tickets. Direct sunlight or high temperature may cause permanent damage to the Ticket.

5. The terms and conditions specified by the Event Partners may exclude the opportunity to issue a duplicate of the Ticket in the event of its loss, theft, damage or destruction. A duplicate of the Ticket may be issued against payment.

6. The seat taken by the User during the Event must be consistent with the seat number specified on the Ticket. Ticketmaster, the owner or manager of the Venue and the Event Partner reserve the right to replace the seat initially assigned to the User or specified on the Ticket with other seats of the same or higher price category, before or during the Event.

7. Tickets may not be exchanged or returned upon the purchase.

8. Before the purchase of the Ticket, the User is obliged to read the present Terms and Conditions and the details of the Event.

§8 Limitations

1. For each Event, there is a limited number of Tickets available for purchase. The number of Tickets that may be purchased is specified on the first page informing of the terms and conditions of purchase and it is verified during each transaction. The Event Partner reserves the right to cancel the Tickets above the allowed number without notice in the event of exceeding;

a) the limit per one household ( address of residence ),

b) the limit per one credit card,

c) the limit per one User.

The Event Partner can cancel all orders of this User.

2. Tickets may be sold subject to certain access or use limitations, such as a limited or obscured view or side view, as well as the minimum age required to enter the Event.

3. The purchase of Tickets for the purpose of profitable resale or the profitable sale of Tickets constitute violation of the provisions of law and are considered petty offences under Article 133 of the Code of Petty Offences.

4. Without a written consent of the Event Partner and Ticketmaster, Tickets may not be used for advertising or promotional purposes, in competitions or lotteries.

§9 Cancellation, change of the time, place and programme of the Event, refunds

1. If the Event is cancelled or its programme, time or place are changed, Ticketmaster will inform the Users of this fact without undue delay by posting the relevant information on the website www.ticketmaster.pl. In addition, the Users may receive such information by e-mail.

2. If the Event is cancelled, except for a change of the date of the Event, the User is entitled to the refund of the Order Amount minus the Handling Fee. If the Event takes place for several days and one or several (but not all) days of the Event are cancelled, the User may receive a partial refund corresponding to the number of the cancelled days of the Event. The Handling Fee is non-refundable.

3. If there occur any material changes related to the Event, in particular a change of the date of the Event or a significant change of the place of holding the Event, the User may either reconfirm their order as regards the changed Event on the Terms of the Event Partner, or demand the refund of the Ticket price. If the User fails to notify Ticketmaster of their decision, Ticketmaster may reconfirm the User's participation in the changed Event, and thus deprive the User of the right to demand the refund of the Ticket price.

4. In order to return the Ticket, the User should send the Ticket return form

and the proof of purchase and original Ticket to the Ticketmaster adress by post. As regards a Ticketfast, the User should send the completed Ticket return form to the e-mail address: info@ticketmaster.pl along with the Proof of Purchase and Ticketfast.

5. A material change means a change that renders the Event materially different from the Event reasonably expected by the Users. The use of doubles in theatrical performances and/or any change as regards:

a) additional performances,

b) group members, and/or

c) programme of an Event with numerous performers (e.g. a festival) are not deemed significant changes.

§10 Enquiries and complaints

1. Any enquiries or complaints related to the purchase should be referred to the User Service along with the order number. The order number can be found on www.ticketmaster.pl under the “My Tickets” tab.

2. In the event of any dispute, Ticketmaster will make best efforts to resolve the dispute in the manner that will satisfy all interested Parties.

§11 Liability

The independent services ordered by the User, including tourist, hotel and accommodation services related to the Event, are organised at the User’s own risk. Ticketmaster is not liable to the User for the lack of opportunity to use such services.

§12 Entrance and participation

1. The manager of the Venue reserves the right to deny access to the Event if the User violates any terms and conditions of the Event or the terms and conditions specified by the Event Partner. The manager of the Venue may conduct occasional security checks in order to ensure the Users’ safety.

2. If any Users are late for the Event, efforts will be made to enable them to access the Event during a break; however, it may not be guaranteed that such Users will be able to attend the Event.

§13 Privacy

1. Ticketmaster Poland sp. z o. o. collects, stores and secures the Users’ personal data in accordance with the Personal Data Protection Act of 29 August 1997.

2. The personal data provided by the User is processed in order to perform the Ticket sales agreement and, at the User's consent, in order to provide information about new products, services and promotions offered by Ticketmaster.

3. The personal data disclosed by the User may be transferred to the Partner of the Event for which the User purchased a Ticket, only for the purposes related to the User's participation in the Event.

4. The User may access, rectify and complete their personal data, as well as demand its removal.

5. On the establishment of the account in the Sales System, the User consents to the processing of their personal data by Ticketmaster for the purpose of fulfilling the Ticket purchase orders or processing any returns or complaints.

§14 Final provisions

1. Any matters not settled in the present Terms and Conditions shall be governed by the provisions of the Civil Code.

2. Any disputes with the User shall be settled by the common court of competent jurisdiction determined pursuant to separate provisions.

This Purchase Policy is designed to ensure your satisfaction and understanding of the purchase process on ticketmaster.pl. This Purchase Policy incorporates our Terms of Use by this reference.

1. General

1.1 We sell tickets and associated products and/or services on behalf of promoters, producers, teams, performers and venues. We refer to these parties who organise or provide the event and/or from whom we obtain tickets and/or associated products or services to sell to you as our "Event Partner". We do not organize any Events ourselves.

1.2 We sell tickets as and when allocated by Event Partners. The quantity of tickets made available for sale by us vary on an event by event basis. Tickets are generally sold through several distribution points, including online, call centres and, in some cases, box offices. All distribution points access the same ticketing system and inventory, therefore tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event, however Ticketmaster does not control this inventory or its availability.

1.3 For some events, Event Partners allocate Platinum Tickets for sale by us. Platinum Tickets are premium tickets at market driven prices, which are usually higher than their face value. Platinum Tickets do not include any additional benefits such as merchandise.

1.4 For some events, tickets may be sold as part of a "Package" (where a ticket for an event is sold together with concessions, merchandise or other valuable benefits such as exclusive seating arrangements, accommodation, transport, dining or merchandise as an inclusive package at an inclusive price) or with an "Upsell" (where, in addition and separately to a ticket, a customer is given an opportunity to purchase car parking, merchandise, travel etc).

1.5 In this Purchase Policy, we refer to any products and/or services offered for sale by us (such as tickets, Platinum Tickets, Packages and Upsells) as "Items". Any reference to a ticket includes (where relevant) a Platinum Ticket.

1.6 To purchase Item(s) from us, you must be 18.

1.7 Our Purchase Policy does not apply to any purchases made via Groupon. If you have any queries or complaints regarding you purchase of tickets from Groupon, please contact them directly. We act as Groupon's fulfilment partner and are not responsible for any ticket arrangements, save for delivery of tickets to you.

1.8. We sell the digital content so if you purchase such content from us please check that you have the necessary operating system and software/hardware to enable you to use digital content. Details regarding technical requirements will be provided to you at the time of the purchase.

2. Contract

2.1 Any purchase of an Item from us is subject to: (i) this Purchase Policy; (ii) any special terms and conditions which may be displayed on our website; and (iii) the terms and conditions of the Event Partner(s) and/or event, which can be found on their respective websites. Venue terms may also be available at the venue box office.

2.2 All purchases are subject to payment card verification and other security checks and your transaction may be cancelled if it has not passed our verification process.

2.3 You agree not to obtain or attempt to obtain any Items through unauthorised use of any robot, spider or other automated device or any other illegal or unauthorised activity. We reserve the right to cancel any transaction which we reasonably suspect to have been made in breach of these provisions to you and any and all Items purchased as part of such transaction will be void.

3. Prices and fees

3.1 Purchases from us may be subject to a per Item service charge and a per order handling charge. You will be informed about all costs while submitting an order.

3.2 The price of Platinum Tickets may vary as it is set according to demand at the time of purchase. You pay the price displayed on our website at the time you make your purchase but the price of similar Platinum Tickets may increase or decrease after you have made your purchase. You will not be entitled to a refund if the price of similar Platinum Tickets subsequently falls.

3.3 Please note that the price printed on Platinum Tickets is usually its face value rather than the purchase price. You will not be entitled to a refund on the basis that you have paid a higher price than the face value of the Platinum Ticket. Market-based pricing allows us to give fans access to the best tickets, whilst enabling Event Partners to price tickets closer to their true value. The price paid for a Platinum Ticket represents its true value at the time of purchase.

3.4 Whilst we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of any Item you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price (and credit or debit your account as applicable) or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect price, you will receive a full refund from us.

4. Ways of payment

You can pay using credit card issued in your name (Mastercard, Visa) or by online bank transfer. In some cases, offline bank transfer will also be available. Details will be presented and the method of payment will be chosen by you during the purchase process.

5. Delivery

We ship tickets using Polish Post, courier or there may be the option to collect from a box office or have tickets delivered electronically to be printed at home using our TicketFast option (which requires a programme to display pdf documents and a printer). Other products may be delivered using Polish Post or couriers. Details and associated costs will be presented and the way of delivery will be chosen by you during the purchase process.

6. Cancellations

6.1. Exclusions

You are not entitled to cancel your contract for the purchase of the following items:

(a) a ticket (including any platinum ticket);

(b) a Package;

(c) any "Excluded Upsell" being any product and/or service purchased separately from and in addition to a ticket, which includes:

• any travel, catering, accommodation, transport or services relating to leisure activities, to be provided on a specified date or during a specified period;

• any goods that are made to your specifications or are clearly personalised;

• any sealed audio or sealed video recordings or sealed computer software, if such goods become unsealed after delivery;

• any alcoholic beverages where: (i) the price has been agreed at the time of the conclusion of the contract; (ii) delivery of them can only take place after 30 days; and (iii) their value is dependent on fluctuations in the market which cannot be controlled by the relevant Event Partner;

• any goods which are liable to deteriorate or expire rapidly; and/or

• any goods which become mixed inseparably (according to their nature) with other items after delivery.

(d) Any digital content which is not supplied on a tangible medium purchased during the 14 days immediately before its release date or at any time on or after the release date – where the content was delivered with your prior express consent for it to be delivered before lapse of 14 days’ period for cancelation and your acknowledgment that you thereby lose your right to cancel.

6.2. Right to cancel

You have the right to cancel your contract for purchase of the following products or services, without giving any reason:

(a) any product purchased separately from and in addition to a ticket (other than any Excluded Upsell), within 14 days of the date of delivery of such product to you (or during such longer period as may be specified in the Event Partner's terms and conditions);

(b) a gift card, within 14 days of the date of delivery of the gift card to you;

(c) digital content which is not supplied on a tangible medium purchased more than 14 days before the date of release of such content, within 14 days of the date of purchase.

This right does not apply to you if you are a business customer.

6.3. Cancellation

(a) To exercise the right to cancel, you must inform us of your decision to cancel your purchase by a clear statement (e.g. a letter sent by post to Ticketmaster Poland spółka z ograniczoną odpowiedzialnością, 22B Bukowińska Street, 02-503 Warszawa, Poland, info@ticketmaster.pl, phone 22 395 87 00,.

(b) You can also request cancellation by contacting us here info@ticketmaster.pl. If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation by e-mail without delay.

(c) To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period (as set out in clause 2 above) has expired.

6.4 Effects of Cancellation

(a) If you cancel your purchase, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

(b) We or our Event Partner on whose behalf we sell products and/or services, may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you other than what is necessary to establish the nature, characteristics and functioning of the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

(c) We will make the reimbursement without undue delay, and not later than:

(i) 14 days after the day we receive or the relevant Event Partner receives back from you any goods supplied, or

(ii) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or

(iii) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel your purchase.

(d) We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

6.5. Returns

(a) If you have received the product before your request for cancellation of the purchase of such product, you shall send back such product without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation to us, as follows:

(i) if the product has been provided to you by our Event Partner, you shall send the product to the relevant Event Partner, to such address as notified by us to you or as displayed on our website; or (ii) if the product (such as a gift card) has been provided to you by us, you shall send the product to us at Ticketmaster Poland spółka z ograniczoną odpowiedzialnością, 22B Bukowińska Street, 02-703 Warszawa, Poland, info@ticketmaster.pl.

(b) You will have to bear the costs of returning the product (unless otherwise stated by the relevant Event Partner).

7. Delivery

7.1 We aim to dispatch tickets as soon as possible. We are not able to specify the exact dates of dispatch, as the arrangements for dispatch depend on when we are in possession of the ticket stock used for a particular event. For some events, we receive ticket stock from our Event Partners close to the event date.

7.2 Please allow as much time as possible for your tickets to arrive. If your tickets have not arrived five days before the event (or, if you are travelling, five days before you leave on your journey), please contact us. Please include your reference number and the name and postcode the booking is made under.

7.3 The tickets may be delivered to you using TicketFast.

7.4 We post tickets to the billing address of a credit card. If the address in your booking does not correspond to that held by your credit card company, we may cancel your tickets.

7.5 We reserve the right to make tickets available for collection by you at the venue box office. We will notify you by telephone or email of the arrangements for collection (using the details provided by you at the time of ordering) if this becomes necessary. You may be required to provide your booking confirmation email and your photo ID to collect tickets.

7.6 Delivery options will be presented to you while submitting an order.

7.7 Any and all products and/or services included in a Package or sold as an Upsell are provided and fulfilled by our Event Partners, who are responsible for the delivery and the quality of such products and/or services. If you have any queries or complaints regarding the Upsell and/or the non-ticket element of the Package, please contact us or the relevant Event Partner directly. For contact details, please refer to the disclaimer on our website or to the booking confirmation email.

8. Tickets

8.1 Any ticket you purchase from us remains the property of the Event Partner and is a personal revocable licence which may be withdrawn and admission refused because of significant reasons. If this occurs, you will be refunded the sale price of the ticket which has been withdrawn or for which access was refused (including the relevant per ticket service charge).

8.2 Policies set by our Event Partners, may prohibit us from issuing replacement tickets for any lost, stolen, damaged or destroyed tickets. For example for non-seated events, allowing a possibility of both the original and replacement tickets being used, may compromise the licensed capacity of the venue. If replacement tickets are being issued, we may charge you a reasonable administration fee.

8.3 When you receive your tickets, please keep them in a safe place. We will not be responsible for any tickets that are lost or stolen. Please note that direct sunlight or heat can sometimes damage tickets.

8.4 As soon as you receive your ticket, please check if everything is correct; mistakes cannot always be rectified.

8.5 You have a right only to a seat of a value corresponding to that stated on your ticket. We, the venue or Event Partner reserve the right to provide alternative seats (whether before or during the event) to those initially allocated to you or specified on the tickets. Such change may be treated as Material Alteration, for more details please see paragraph 8.4.

Restrictions

8.6 When purchasing tickets from us, you are limited to a specified number of tickets for each event. This number is included on the first purchase page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. Tickets may be restricted to a maximum number per person, per credit card and, for some events, a restriction may apply per household. Any such restriction shall be displayed on our website or otherwise notified to you before or at the time you book the tickets. We reserve the right to cancel tickets purchased in excess of this number without prior notice.

8.7 Tickets may be sold subject to certain restrictions on entry or use, such as restricted, obstructed or side view or a minimum age for entry. Any such restriction shall be displayed on our website or otherwise notified to you before or at the time you book the tickets. It is your responsibility to ensure that you read all notifications displayed on our website.

8.8 You may not resell or transfer your tickets if prohibited by law. In addition, Event Partners may prohibit the resale or transfer of tickets for some events. Any resale or transfer (or attempted resale or transfer) of a ticket in breach of the applicable law or any restrictions imposed by the Event Partner is grounds for seizure or cancellation of that ticket without refund or other compensation.

8.9 You may not combine a Ticket with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create a package, unless formal written permission is given by us and the Event Partner.

8.10 A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by the Event Partner, provided that even if such consent is obtained, use of our trademarks and other intellectual property is subject to our prior consent.

9. Event

9.1 Our website ticketmaster.pl contains up to date information about events for which we sell tickets, please visit the Website prior to the event to make sure that an event has not been cancelled and the date and time of an event has not been changed. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify you of the cancellation once we have received the relevant authorisation from the Event Partner.

9.2 Please note that advertised start times of events are subject to change.

9.3 Tickets are sold subject to the Event Partner's right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets, unless such change is a material alteration as described in paragraph 8.4, in which case the provisions of this paragraph shall apply.

10. Refunds

10.1 Occasionally, events are cancelled, rescheduled or materially altered by the team, performer or Event Partner for a variety of reasons. Contact us for exact instructions.

10.2 Cancellation: If an event is cancelled (and not rescheduled), you will be offered a refund of the sale price of your ticket(s), including the relevant per ticket service. If an event takes place over several days and one or more day(s) is/are cancelled (but not all the days constituting the event), a partial refund only may be payable corresponding to the day(s) cancelled. For payments via Dotpay or credit card you will be charged a service fee of 3% of the sum of the transaction (which consists of the ticket price + possibly other charges). Service fee is not refundable

10.3 Rescheduling: Unless indicated otherwise in relation to a particular event, if an event is rescheduled, you will be offered seats at any rescheduled event (subject to availability) of a value corresponding with your original tickets. If you are unable to attend the rescheduled event, you will be offered a refund of the sale price of your ticket(s) including the relevant per ticket service charge. You must inform us within the time specified by us if you are unable to attend the rescheduled event, otherwise we may reconfirm your booking for the rescheduled date and you will not be entitled to claim a refund.

10.4 Material alteration: If an event is materially altered, you will be offered an option to either reconfirm your order for the altered event or to claim a refund (of the sale price of your ticket(s) including the relevant per ticket booking fee), within such time as specified by us. Failure to inform us of your decision may result in your order being reconfirmed for the altered event and you will not be entitled to claim a refund. A 'material alteration' is a change which, in our and the Event Partner's reasonable opinion, makes the Event materially different to the Event that purchasers of tickets, taken generally, could reasonably expect. The use of understudies in theatre performances and/or any changes of: (i) any supporting act; (ii) members of a band; and/or (iii) the line-up of any multi-performer event (such as a festival) shall not be a material alteration.

10.5 To claim your refund, please apply in writing to: Ticketmaster Poland spółka z ograniczoną odpowiedzialnością, 22B Bukowińska Street, 02-703 Warszawa, Poland (or to such other address as may be notified to you by us). You must enclose your unused tickets and comply with any other reasonable instructions from us. For accounting purposes your unused tickets must be received within 28 days from the date of the cancelled event.

10.6 If you have purchased any Item associated with an event which has been cancelled, rescheduled or materially altered (such as car parking or travel) and a refund of a ticket is due to you in accordance with this clause 8, we will also refund you the purchase price of such Item, including the per Item service charge..

10.7 This Purchase Policy does not and shall not affect your statutory rights as a consumer.

10.8 We regret that, unless paragraphs 8.2, 8.3 or 8.4 apply, tickets cannot be exchanged or refunded after purchase. This does not limit your right to cancel, if applicable, described in clause 4 above.

11. Liability

11.1 Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by you are at your own risk. Except to the extent that it is expressly prohibited by applicable, mandatory law neither we nor the Event Partner(s) shall be liable for you for any loss of enjoyment or wasted expenditure.

11.2 Ticketmaster is not liable to you for any cancellation, rescheduling or any material change to the programme of the event, except for the obligation to refund you the sale price of your ticket(s) including the relevant per ticket service charge, unless such cancellation, rescheduling or material change to the programme results solely from our gross negligence or willful misconduct.

11.3 Neither We nor the Event Partner(s) will be liable for any loss, injury or damage to any person (including you) or property howsoever caused (including by us and/or by Event Partner(s)): (a) in any circumstances where there is no breach of a legal duty of care owed by us or the Event Partner(s); (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury or loss or damage resulting from willful misconduct)); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the terms of this Purchase Policy and/or any terms and conditions of the Event Partner(s) or your negligence.

11.4 Nothing in these Terms and Conditions seeks to exclude or limit our or the Event Partner(s)' liability for death or personal injury or loss or damage resulting from willful misconduct caused by our or the Event Partner(s)' (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited or to limit your statutory rights as a consumer.

11.5 Ticketmaster is liable for defects of objects pursuant to provisions of Civil Code, this does not apply to you if you are a business customer.

12. Admission and Attendance

12.1 The venue reserves the right to refuse admission should patrons breach any terms and conditions of the event or Event Partner. The venue may on occasions have to conduct security searches to ensure the safety of the patrons.

12.2 Every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed.

12.3 There will be no pass- outs or re-admissions of any kind.

12.4 The unauthorised use of photographic and recording equipment is prohibited. Any photos, videos and/or recordings may be destroyed or deleted. Laser pens, mobile phones, dogs (except guide dogs) and a patron's own food and drink may also be prohibited (please check with the venue).

12.5 You and other ticket holders consent to filming and sound recording as members of the audience.

12.6 Prolonged exposure to noise may damage your hearing.

12.7 Special effects which may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects may be featured at an event.

13. Queries and Complaints

13.1 If you have any queries or complaints regarding your purchase, contact us at[ provide address or hyperlink], quoting your order number given to you at the conclusion of placing the order.

13.2 Because we sell Items on behalf of Event Partners, we may need to contact them for more information before responding to your complaint. Some complaints can take up to 28 days to resolve, but we will get back to you as soon as possible.

13.3 If any dispute arises, we shall use our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to both you, us and the Event Partner.

14. Miscellaneous

14.1 All of these terms and conditions are governed by Polish Law and any disputes arising out of any transaction with Ticketmaster are subject to the exclusive jurisdiction of competent Polish Courts.
